Terms of Service

These Terms of Service govern your access to and use of Vispark, our mobile applications, landing pages, and related services. By using Vispark, you agree to these Terms.

1. Who we are

Vispark is a YouTube companion app that helps users track YouTube channels, request summaries of public YouTube videos, receive notifications about new uploads, and manage subscription-based app features. References to Vispark, we, us, or our mean the operator of the Vispark service.

2. Eligibility and accounts

You must be at least 13 years old, or older if your country requires a higher minimum age for online services, to use Vispark. If you use Vispark on behalf of another person or organization, you represent that you have authority to accept these Terms for them.

Vispark uses Supabase Auth and Google sign-in. You are responsible for maintaining access to your Google account and for all activity that occurs through your Vispark account.

3. The service

Vispark lets you search for YouTube channels, subscribe to channels in the app, request summaries of public YouTube videos, receive automatic summaries when tracked channels publish new videos, view transcripts when available, and manage notification and language preferences.

We may modify, suspend, or discontinue any part of Vispark at any time. We may also impose or change limits on features, including channel tracking, summary request quotas, processing priority, and language availability.

4. YouTube and third-party content

Vispark is not affiliated with, endorsed by, or sponsored by YouTube or Google. YouTube videos, channels, thumbnails, titles, descriptions, transcripts, and related materials remain the property of their respective owners.

When you use YouTube-based features, you must comply with YouTube's terms, Google's policies, and all applicable laws. We are not responsible for the availability, accuracy, legality, or content of third-party videos, transcripts, channels, or websites.

5. Artificial intelligence summaries

Vispark uses automated systems and third-party artificial intelligence providers to generate summaries and related outputs from public YouTube video information and transcripts. Artificial intelligence output can be incomplete, inaccurate, outdated, offensive, or misleading.

Summaries are provided for convenience and informational purposes only. You should independently verify important information before relying on it. Vispark does not provide legal, financial, medical, professional, or safety advice.

6. Your responsibilities

You agree that you will not:

  • Use Vispark for unlawful, harmful, abusive, or deceptive activity.
  • Attempt to bypass quotas, payment requirements, security controls, rate limits, or access restrictions.
  • Submit or process content in a way that infringes intellectual property, privacy, publicity, or other rights.
  • Reverse engineer, scrape, overload, interfere with, or disrupt Vispark or its providers.
  • Use Vispark to create, train, or improve a competing summary, monitoring, or notification service without our written permission.

7. Subscriptions, billing, and refunds

Some Vispark features require a paid subscription. Subscription plans may include channel limits, summary request quotas, priority processing, language features, or other benefits shown in the app or on the landing page.

Purchases are processed through Apple App Store, Google Play, and RevenueCat. We do not receive or store your full payment card details. Your subscription renews automatically unless you cancel it through the applicable app store before the renewal date.

Refund requests are handled by the app store where you purchased the subscription unless applicable law requires otherwise. Downgrading or canceling a paid plan may reduce your quotas or pause channels that exceed the free plan limits.

8. Notifications

If you enable notifications, Vispark may send in-app or system notifications about summaries, processing status, subscribed channels, account activity, and service updates. You can manage notification permissions through the app settings and your device settings.

9. Ownership and license

Vispark, including its software, design, branding, text, graphics, and service features, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not transfer ownership of Vispark to you.

You grant us a limited, worldwide, non-exclusive license to use the information you submit or select in Vispark, including YouTube links, channel identifiers, language preferences, and related request data, only as needed to operate, secure, improve, and provide the service.

10. Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and protect information. By using Vispark, you acknowledge that we process information as described in the Privacy Policy.

11. Termination

You may stop using Vispark at any time. We may suspend or terminate your access if we reasonably believe you violated these Terms, created risk for Vispark or others, failed to pay required fees, or used the service in a way that may cause legal or operational harm.

12. Disclaimers

Vispark is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and security.

We do not guarantee that summaries, transcripts, notifications, subscription status, or third-party integrations will be accurate, uninterrupted, timely, secure, or error-free.

13. Limitation of liability

To the maximum extent permitted by law, Vispark and its operators, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, or service interruption, arising from or related to your use of Vispark.

To the maximum extent permitted by law, our total liability for any claim related to Vispark will not exceed the amount you paid to us for Vispark during the three months before the event giving rise to the claim, or 100 United States dollars if you did not pay us during that period.

14. Indemnity

You agree to defend, indemnify, and hold harmless Vispark and its operators, affiliates, service providers, and licensors from claims, damages, losses, liabilities, costs, and expenses arising from your use of Vispark, your violation of these Terms, or your violation of any rights of another person or organization.

15. Governing law

These Terms are governed by the laws of the jurisdiction where Vispark is operated, without regard to conflict of law rules. Courts located in that jurisdiction will have exclusive authority to resolve disputes, unless applicable consumer protection law gives you rights to bring a claim elsewhere.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as updating the date on this page or providing notice in the app. Your continued use of Vispark after changes become effective means you accept the updated Terms.
